About a week ago, I did an interview with a very successful entrepreneur out of Dallas Texas? his name is Warren Nugent. Warren has a very smooth and polished way about him? completely professional? almost Presidential!

I interviewed him on the Josh Peak Radio Show.

He has a background in the construction industry, but has now thrown his hat into the ring of the crazy world in network marketing. Now I?ve always said, I think the best CEOs in the network marketing and direct sales industry are people who are outsiders. Those are the folks who have built traditional businesses before, and understand the hardships? they haven?t simply been just a rep in a company? who then decided that they?re going to go ahead and start a network marketing company simply because they didn?t like the way thing were ran at the previous company.

Warren is also a strong family man. Actually, his daughter is Ali Nugent, Miss Texas USA 2013, and will be in the running for Miss America. His wife has a phenomenal story, as she overcame a strong form of cancer. Jesse and I has the opportunity to spend a weekend with the Nugent family in Dallas, and have to say? this is one of the most gracious families I have ever been around.

Warren has brought a great story to the marketplace and network marketing. His company is called Terra Biotech, and in this interview, I talked with him on the topics of entrepreneurship? and education versus schooling. Then the processes of what great entrepreneurs do in their minds while pivoting their business idea? how to overcome obstacles! I think this is going to be the type of interview that will inspire a lot of people? then clarify in their minds where to take their business and what the next step is.

Mystery of memory: Why it isn't perfect

When, as an adult, he returned to Alexandria, Egypt, where he lived as a child, writer Andr? Aciman felt he remembered everything; he could walk and never get lost; he recognized the smells. But something was gone: a memory.

Aciman knew he had forgotten because, previously, he had written about this one, a walk he had taken with his brother and their conversation, in a draft of a memoir.

"The editors said that brother of yours, he is one too many children in this book," Aciman told the audience at a discussion about memory at the New York Academy of Sciences on Wednesday. "We changed that, and some of the dialogue I had with him, I reconstructed so I was having an internal dialogue with myself."

But upon returning to that street, he realized he had lost the memory of the original conversation; the only record of it was now contained in his draft, one overwritten by a desire for a better story. Aciman's memory no longer told him which version was true. [ 5 Facts About Your Memory ]

Vulnerable memories
While most people do not write memoirs, and do not have editors requesting revisions to their memories, the experience of the ephemeral and sometimes illusory nature of memory is a familiar one. And Aciman's story came as no surprise to the memory researchers on the panel.?

Flaws in memory can arise at different points in the process, explained Daniel Schacter of Harvard University. When someone first records a memory, the viewer incorporates his or her own reactions and inferences about the event. As a result, the viewer can color or distort the memory from the very beginning.

Other distortions can occur when a memory is retrieved.

"When you recall a memory, it is not just simply read out, you have to store and consolidate (stabilize) it again," Schacter said. During this process, the recalled memory becomes vulnerable to outside influences and can be distorted by them.

The physical basis for memory in the brain is not well understood. Neuroscientists know the creation of memories does not require rewiring of the nerve cells, or neurons, in the brain. Instead, memories are encoded by changes at synapses, the junctions between neurons.

The reason for memory
While the fallibility of memory is impossible to escape, part of the problem may be our perception of its purpose.

"Even though we tend to think about memory being all about the past, it is really all about helping us prepare for the future," Schacter said.

Some researchers think these lapses are byproducts of memory functioning in ways evolution intended. For instance, the vulnerability of retrieved memory may be a result of the brain?s need to update memory and get rid of irrelevant information, he said.

Some false memories may have a similar explanation. Schacter, who has studied brain activity related to true and false memories, demonstrated how easily memory could be faked. He listed a string of words, beginning "candy, sour, sugar, bitter, good ?" Then he asked the audience to remember if a certain word was part of the list. When asked if the word "sweet" was on the list, the majority of the audience members raised their hands.

"Sweet was not on the list," Schacter said, explaining, "Most of the words are related to sweet."

In cases like this, the false memory may be a result of the brain distilling the most relevant aspect of a memory, he said. [ Do You Really Remember Where You Were on 9-11? ]

How technology defines memory
The idea of memory being continually constructed is not new, though it has gained popular acceptance only in recent decades, said panelist Alison Winter, a historian of science and medicine at the University of Chicago.

Throughout the ages, there has been a relationship between the recording technology available and the perception of how the brain stores past experiences, Winter said. For instance, wax tablets, once used as writing surfaces, provided a metaphor for memories that soften and eventually blur over time. Devices that record not only information but also the passage of time, such as audio-recordings and film, made the idea of flashbacks, when someone re-experiences the past in real-time, a common one.

"I am curious if new digital technology has helped people think about memories in a more constructive way," Winter said. Altering photographs and other records, even before they are seen by anyone else, is now quick and easy. This experience may give people a much more dynamic sense of how memories themselves are stored, she said.?

Erasing the bad
While some hope to improve their recall, others seek to erase painful memories.

After work in his lab appeared to rewrite rats' fearful memories, panelist Joseph LeDoux, a neuroscientist at New York University, said researchers heard from people desperate for relief from painful memories.

Previous research had shown that injecting a drug that blocks the formation of proteins could prevent the formation of new long-term memories in the amygdala, a part of the brain associated with fear. But what about existing memories?

To find out, LeDoux and his colleagues taught rats to associate a tone with an electrical shock, as a result the rats became afraid of the tone. After the fear memories were established, the researchers prompted the rats to recall them by exposing the rats to the tone again, then they gave the animals the drug. When the rats were tested the next day, they were no longer afraid of the tone.

"The idea is each time you take memory out, it becomes vulnerable," LeDoux said. "There is a lot of debate about the conditions under which this applies," he added.

Unfortunately for those seeking to erase bad memories, this work is not directly applicable to humans, he cautioned. "When we do these kinds of experiments in animals we are focusing on brain systems that work implicitly or unconsciously. ? We are not really looking at fear, we are looking at fear responses."

In this case, the researchers looked to see if the rats froze in response to the tone.

Painful human memories, such as those of combat veterans, cannot be erased, but rather, research shows their emotional impact may be dampened, LeDoux said.?

This panel discussion was part of a four-part series on consciousness, moderated by Steve Paulson, of the public radio program "To the Best of Our Knowledge" and presented by the Nour Foundation.

More than 40 years ago, Henry S. Miller Jr. allowed me the honor of associating as a broker with the then predominant brokerage firm within Dallas-Fort Worth. The only opening was as an associate in a new group within its land division, working for Buddy Archer, a brilliant technician who was very creative in new types of financing land joint ventures.

Having just separated from the Air Force, I appeared daily in my BX-purchased, lime green, polyester, bell-bottom suit. I had the good fortune to observe Buddy, the best in his field, and to occupy a desk in the hall next to a rookie quarterback for our local pro football team.

The market?s desire for speculatively financed land deals was strong. A total of 10 years prepaid interest was deductible and desirable to many sellers. Young, naive, hungry, I dove in and was bountifully rewarded. I bought a Jim Kienest house, had a baby boy (well, Jeri, my wife, did), and got the first Datsun 240 Z. The Rolex would come in a later up cycle. Life was good, working with the now back-up QB for that same local sports team.

In 1974, the tax laws inexplicably changed, retroactively invalidating all those wonderful tax shelters we had grown to love. I mean, who could have known? The desire for land approached the level of contracting West Nile. During the next three years we restructured our holdings, converting interest to principal where possible or returning the title to the sellers, neither of which produced any minor form of living expense. The nice house was exchanged for more humble living quarters, the boy forfeited daycare, and posting for adoption was not remote, and the Z was converted to an older Mercury Station Wagon.

The professional athlete had moved on to office buildings, a move I tried to tell him was a huge mistake. I mean, really, who could have known?

The next 35 years went on to produce similar cycles, some higher, some lower, particularly the late 1980s, which I like to refer to as the ?F?ing years. You remember: ?F?DIC, ?F?SLIC, ?F?ADA, and, of course, the ?F?ing RTC. (Oh, sorry, no ?F.?)

One common observation, however, has never been violated. If a land investor applied good judgment in acquisition price, location, and was well financed, he would enjoy a profitable experience over time. That investor will only be successful when he sells to someone who wants his asset more than he does. If his financial situation dictates he must sell, his opportunities dissolve. Expect and be prepared for your land investment to finance your yet-to-be-born grandchild?s college education, and wait to be pleasantly surprised in the interim. (Note: Review Mr. Perot?s purchase of 20,000+ acres at Alliance and 2,000+ acres in Legacy, then check his ranking on Forbes? annual list.)

If the Fed is even close to its predictions, Dallas-Fort Worth will grow by more than 2 million people over the next 20 years. These people must have a place to live, shop, play, work, and drive their Datsuns. Despite what most developers think, they cannot all move to Uptown, West Village, or Sundance Square. Job growth will transition to economically attractive areas, and employees will follow.

The 10,000 or 20,000 thousand acres this growth will absorb will not be inside LBJ or I-820. As an early mentor used to say, ?Under all lies the land.?

The real estate market will cycle again and again. Be patient and perceptive. Just because it is cheap doesn?t mean it is a good value?unless it is in Uptown, of course. ?Buy land and go west young man; they aren?t making any more of it.? (OK, mixed metaphors, but applicable.)

A sweet scene at the inaugural Indulgence Festival | IndyBlog

The first Colorado Indulgence Festival was held this past weekend at the Colorado Springs Fine Arts Center.

Check out this slideshow of the event, if photos of chocolate and the like melt your marshmallow. (Yup, just made that phrase up, to my own embarrassment.)

According to co-organizers Red Energy PR, some 800 guests and vendors raised $3,000 for the Zonta Club of the Pikes Peak Area.

The event was organized so that guests were able to try at least one food sample from each vendor (some allowed more, especially toward the end of the night) and to vote for their favorite items.

To some extent, it felt more like a pre-holiday-shopping tasting, a little like Coaltrain's Infamous Christmas Sale Tasting, in that guests could try different chocolates, for example, before committing to purchase a small box as a gift or treat.


In that regard, it's a great preview opportunity and a little more consumer-driven than other town foodie events.

The crowd was a bit overwhelming in the early hours, as people politely guarded their elbows through the FAC's narrow glass corridor, braving a few lengthy lines for such samples as a scoop of gelato, portion of a truffle, cake pop, fudge hunk or mini cookie.

Beyond the sweets, there were wine and spirits pours to be savored and a few retail booths peddling spa packages and the like.

VIP guests could retreat to a small room with basic provisions sans lines, and could attend four special food and drink demos: one on cheesemaking, one on wine tasting methods, one on chocolate's healthy aspects, and one on how to make chocolate martinis.

And to a few of my passing impressions, in no particular order:

? The stand-up-and-mingle-roam-sip-and-graze style of the Indulgence Fest keeps the atmosphere lively and active ? it's certainly no snoozer with everyone's blood-sugar levels spiked.

? There was an impressive showing of chocolatiers and sweets artisans from all over the state, rather than just Colorado Springs, which was refreshing and exciting to those of us who've already sampled from the majority of the locals. Simply put: New flavors = fun.

? And chocolate in its many forms is awesome, so it's nice to have an event that largely spotlights it, since it's one of the first items to come to mind when one hears the word "indulgence." On that note, I'm rather intrigued by Xocai Healthy Chocolate, which claims a number of benefits related to fighting free radicals via super-high antioxidant properties in its chocolates, which are delicious.

I am, however, skeptical of the majority of multi-level marketing businesses where reliance on a local distributor (versus easy access through retailers) is necessary. Though the Xocai representative in attendance was a retired doctor who cited reputable scientific studies, I couldn't help but approach cautiously.

That said, if the chocolate does everything they say it does, it's certainly a delightful way to intake the nutrition.

While on the skeptical tone, and speaking as an homeowner who made the environmentally friendly investment of Renewal by Anderson windows years ago, I'm honestly not sure where they fit into the theme of indulgence, beyond their hefty price tag. It was a strange booth to see wedged between all the sweets stops.

But to end on a far from skeptical, completely converted note, I'd like to briefly shower praise on two fantastic truffle makers: Monument's The Art of Chocolate and Denver's Black Star Chocolates.

The Art of Chocolate's balsamic strawberry truffles are just stupid yummy, with a tangy, fruity brightness.

And Black Star's basil lemon truffle and rosemary caramels are simply genius in the way they seamlessly infuse the unexpected garden herbs into the dessert treats.

Those are just the ones I was able to try at the festival ? I'm excited for further samplings from both in the future.

If you don't have time to peruse the other vendors' websites ? a list of participants can be found at indulgencefestival.com ? then consider truffles from these two companies as a very safe and sure-to-be-enjoyed gift this or any season.

And if you're looking for a chocolate treat with a little more edge to it: The Chocolate Bordello has built a fun truffle line around women of ill repute. The Fairplay-based business has named and designed each chocolate after prostitutes from both Colorado history and the Bible. Scandalously delicious.

Android 4.2 has a hidden Jelly Bean Daydream

Yesterday, we told you about a new feature of Android 4.2 called Daydream, which is essentially a screensaver for your Android phone or tablet that is triggered when you set your device to charge, or place it in a dock. Well, it turns out that Google (as it often does) has hidden a big of an Easter egg in the form of a special Jelly Bean Daydream.This new Daydream is unlocked after you go to checkout one of Google's standard Android Easter eggs: the version art. Ever since Android 2.3 Ginger Bread, if you go to Settings>About device and tapped repeatedly on the Android version number, you'd get the version art. Gingerbread had a gingerbread zombie, Honeycomb had the Android bee, Ice Cream Sandwich had the Android Nyan cat, and Jelly Bean has the floating jelly beans (and singular candy cane).?

It turns out that after you check out the version art Easter egg in Android 4.2, a new Daydream is unlocked which allows your device to display the floating jelly beans when charging/docked. Even better is that this Daydream is interactive, and you can fling the beans. The lack of interactivity was something that disappointed us about the other Daydreams.?

Consumer prices rise as cost of shelter jumps

WASHINGTON - Consumer prices rose in October as the cost of shelter surged by the most in over four years, while gasoline prices fell in a boost for consumer spending power.

The Consumer Price Index increased 0.1 percent last month, in line with analysts' expectations, data from the Labor Department showed on Thursday.

The data still pointed to only modest inflation pressures that appear unlikely to derail the U.S. Federal Reserve's plan to keep interest rates low for an extended period.

Prices for shelter, which include rent, rose 0.3 percent during the month, the most since 2008, and accounted for over half of the overall increase in the CPI. That could be a hopeful sign for the economy if it is because landlords felt they have more leverage to raise rents. Rents for primary residences rose 0.4 percent.

Gasoline prices fell 0.6 percent in October after climbing 7 percent the prior month. That was the first drop in gasoline prices since June. Higher costs at the pump have forced many American consumers to cut back on other spending.

A measure of underlying inflation was relatively muted. The core CPI, which excludes food and energy prices, increased 0.2 percent.

In the 12 months to October overall consumer prices increased 2.2 percent, up a tenth of a point from September's reading. Core prices rose 2 percent in the year through October.

Most economists don't see inflation threatening the economy in the short or long term.

However, some believe the U.S. Federal Reserve would tolerate prices rising faster than the central bank's 2 percent target over the shorter term to allow faster economic growth as the country recovers from the 2007-09 recession.

The Fed targets a separate measure of inflation calculated by the Commerce Department which tends to run cooler than the CPI.?

NYSE, Honeywell CEOs call for action on "fiscal cliff"

NEW YORK (Reuters) - U.S. politicians face a stark choice over the next six weeks: come together on a deal to avoid the fiscal cliff, or prepare for a recession as companies seek other places to invest, said the CEOs of NYSE Euronext and Honeywell International Inc.

President Barack Obama and congressional Republicans have sounded conciliatory notes on the fiscal cliff since last week's election, but there is still plenty of scepticism in the business community on the chances of a deal, NYSE's Duncan Niederauer and Honeywell's David Cote told Reuters on Tuesday.

In August 2011, Congress did not agree on raising the U.S. debt ceiling until the last possible minute, leading to massive volatility in equity markets and a downgrade of America's debt rating.

"If the debt ceiling was playing with fire, this is nitroglycerine," said Cote. "If they go off the cliff, I think it would spark a recession that's a lot bigger than economists think. Some think it would just be a small fire. I think it could turn into a conflagration."

Since the election, markets have been focused on the fiscal cliff of steep government spending cuts and tax rises due to be implemented under existing law in early 2013 and the uncertainty surrounding it, along with more long-term fears about the size of the U.S. debt, Big Board boss Niederauer said.

"The next 60 days are critical," he said.

He said the market seemed to be pricing in more uncertainty in the months ahead, and that there could be an upside surprise in store if real progress is made in the lame-duck session of Congress, which would set the table for a credible solution to conquering the debt burden in the following months.

CAPITAL IS A COWARD

Niederauer said that uncertainty - including around simple things like what the corporate tax rate will be in 2013 - makes it difficult for companies to make plans to invest and hire workers in the United States, further stifling economic growth.

While the economy has struggled since the recession, corporations are sitting on stockpiles of cash and are waiting for a signal as to where to invest, said Niederauer.

If politicians are not able to create some certainty in the markets by putting aside partisan ideas, and making real progress in the next 60 days on fiscal issues, money will likely go elsewhere, both Niederauer and Cote said.

"We simply won't be investing in the United States. We will be investing elsewhere, where we have more certainty of the outcome," Niederauer said.

"Capital is a coward," said Cote of Honeywell, a diversified manufacturer. "You don't go to places that are excessively risky or have more risk in them than you are willing to take."

He said that with many of the world's big democracies - Japan, India, the EU, the United States - in gridlock because of debt, somebody needs to exercise some leadership.

"There is a real opportunity for presidential leadership. That is the one guy in the entire country who could make this argument to the American public and give it to them holistic instead of in pieces," Cote said.

Both Cote and Niederauer said they were optimistic a deal will be reached in time.

WHAT A PLAN MIGHT LOOK LIKE

Democrats and Republicans generally agree on the need to avoid about $600 billion in deficit-reduction measures set to start in 2013. But they are at odds how to get over the immediate crisis, divided over whether to extend tax cuts for everyone, as Republicans want, or just for those earning below $250,000, as the president wants.

Solving the problem requires "both an increase in taxes and significant entitlement reform, along with discretionary spending cuts if this is going to work, and we need this to work," Cote said.

Both Cote and Niederauer are part of an ad hoc lobby group called Fix the Debt, made up of CEOs pushing for long-term deficit reduction, and Cote is one of several CEOs meeting with President Obama on Wednesday to discuss fiscal issues.

"He (Obama) fully understands the significance of not just the fiscal cliff, but long-term debt, to our economy and what that's doing to hold us back and wants to do something that's going to really make a difference here long-term," he said.

Obama also plans to hold a news conference on Wednesday, during which he will be questioned about negotiations.

Cote said it was not reasonable to expect Congress to come up with the bigger $4 trillion answer by the end of the year. It could, however, put a mechanism in place to develop a simplified tax system that collects more, simplified Medicare/Medicaid that spends considerably less, and discretionary spending cuts, by a specified date such as July 4, he said.

Of the $4 trillion in deficit reduction, which would be phased in over 10 years, Cote said a plan might include $1 dollar in tax increases for every $3 of spending cuts.

There would also need to be a backup - like a Simpson-Bowles, a Domenici-Rivlin, or another $4 trillion debt reduction plan - that would automatically kick in if the plan is not ready by the target date.

Cote, whose name has been brought up by pundits as a potential replacement for Timothy Geithner as Treasury Secretary, said he has not given that role much thought.

"It's nice to be thought about, but I like what I am doing," he said when asked if he would consider the job if offered.

Top executives scheduled to meet with the president on Wednesday include the CEOs of General Electric Co, Wal-Mart, Ford Motor Co, Procter and Gamble Co, American Express, Chevron Corp, International Business Machines, PepsiCo Inc, Xerox Corp, and Aetna Inc.

Update: Both Nexus 4 models are already sold out in the EU, less than an hour after going on sale. The Nexus 10 16GB remains available for sale at the time of writing. Google's been having some technical difficulties, as the Play Store grinds to a halt under the demand for orders. In addition, the 3G, 32GB Nexus 7 has also appeared for sale on Google Play today.

We're told to expect Google to begin taking U.S. orders around 9am PT.

The Role of Urban Planners in Negotiations: Case Study of Israeli-Palestinian Negotiations

Can urban planning tools help negotiators develop creative solutions to complex disputes?? Karen Lee Bar-Sinai, Loeb Fellow at Harvard Graduate School of Design (GSD), recently explored this topic in a talk entitled ?The Role of Urban Planners in Negotiations: Case Study of Israeli-Palestinian Negotiations.? The first in a series of seminars co-sponsored by the Middle East Negotiation Initiative at the Program on Negotiation and GSD, Bar-Sinai?s presentation offered some intriguing suggestions for how integrating urban planning into the process of negotiation could be beneficial, and sparked a lively discussion on the limits and potential of this approach.

Bar-Sinai began the talk by noting that territorial conflicts often manifest themselves through the built environment, and that negotiations related to these conflicts could be enhanced by creative spatial thinking by urban planners. To bring to light the importance of innovative planning, she cited Professor Shari Motro, who stated that ?a skilled designer can make peace seem inevitable or impossible, reassuring or terrifying, logical or jumbled.?

Bar-Sinai suggested that the practice of bringing spatial awareness into conflict resolution, coined ?resolution planning,? brings together three spheres: people, politics, and planning. She then explored how resolution planning can enhance negotiations in multiple ways: by bridging the gap between agreements, words, and reality; by creating a spatial toolkit for negotiators and interested parties; by emphasizing flexibility and creative options for ?enlarging the pie,? and by connecting the challenge of finding a negotiated settlement to a broad vision of urban planning.

In her talk, Bar-Sinai drew lessons from her work at SAYA/Design for Change, an Israel-based company co-founded by Bar-Sinai and Yehuda Greenfield-Gilat that specializes in what can be called ?peace architecture? ? an architecture and design practice that uses planning, architecture, design, and visual tools to support decision-making, negotiations and peace processes in areas of conflict.

After the presentation, James Sebenius, a Harvard Business School professor and faculty-affiliate of PON?s Middle East Negotiation Initiative, moderated a lively question and answer session.? Some attendees questioned Bar-Sinai about the limits of utilizing urban planning tools, which deal only with spatial aspects of land, in a conflict where land has symbolic or emotional meaning as well.? The creative potential of this approach and the applicability of resolution planning to other conflicts were also discussed.

Bar-Sinai?s talk was the first in a series of three seminars examining how urban design thinking and planning can aid the negotiation process in general.? The seminar series is being organized by Dr. Shula Gilad, Senior Fellow at PON, and Karen Lee Bar-Sinai.? The second session, entitled ?The Role of Architecture in Negotiations: Designing a ?Yes? in Jerusalem,? will be held at Harvard?s Graduate School of Design on November 20, 2012.

RIM to release new BlackBerrys soon after Jan. 30

TORONTO (AP) ? Research In Motion Ltd. will release its much-delayed BlackBerry 10 smartphones "not too long" after a launch event on Jan. 30, a senior executive said Tuesday.

Chief Operating Officer Kristian Tear said the company is still fine-tuning the new phones.

The new phones are seen as critical to RIM's survival as the smartphone pioneer struggles in North America to hold on to customers who are abandoning BlackBerrys for flashier iPhones and Android phones. The new BlackBerry 10 system is designed for the touch screen, Internet browsing and apps experience that customers now expect. RIM's current software is still focused on email and messaging and is less user-friendly, agile and robust than iPhone or Android.

On Monday, RIM said details on the BlackBerry 10, including specific availability, will be announced at the event. A touch-screen-only device is expected to be released first followed shortly after by a version with a physical keyboard. Many people still gravitate to BlackBerrys specifically for their physical keyboards, and RIM hasn't succeeded in the past with touch-only offerings.

Tear said RIM wants to be the No. 1 mobile computing platform, despite the dominance of Apple and Android. He said the Waterloo, Ontario-based company believes it can compete with Silicon Valley because it has access to a lot of talented people and two great universities in the area. He said he's been involved in two turnarounds before with Sony Ericsson and Ericsson and believes in RIM's new management.

"It's not going to be easy," Tear said. "But everybody is super-focused and super-commited. We're going to show the world that we are turning this around."

Steve Zipperstein, RIM's new chief legal officer, said RIM invented the smartphone and has been the innovator in the mobile space for a long time.

"We're not going away," Zipperstein vowed. "We're going to succeed with BB 10. We're going to impress our customers. We're going to fight every day."

Tear and Zipperstein were hired this past summer by CEO Thorsten Heins, who took over RIM in January after it lost tens of billions of dollars in market value. Heins had vowed to do everything he could to release BlackBerry 10 this year but said in June that the timetable wasn't realistic. The new BlackBerrys will be released after the holiday shopping season and well after Apple's September launch of the iPhone 5.

Heins is counting on BlackBerry 10 for a turnaround.

RIM's platform transition is happening under a new management team and as RIM lays off 5,000 employees as part of a bid to save $1 billion this year.

RIM was once Canada's most valuable company with a market value of more than $80 billion in 2008, but the stock has plummeted since, from over $140 per share to around $8. Its decline evokes memories of Nortel, another former Canadian tech giant, which declared bankruptcy in 2009.

RIM's stock fell 41 cents, or 4.7 percent, to close at $8.40 Tuesday in New York after rising as high as $9.07 the previous day, when RIM announced its Jan. 30 launch date.

You may not think twice about laying around the house on a sunny day, serving yourself heaping portions of food or perpetually sipping soda, but know that your kids are watching you.

They probably won?t talk with you about the health risks of being a couch potato or scold you about the abundance of calories you?re eating and drinking because, to them, this is normal.?

Regardless of whether our lifestyle habits are good or bad, our kids perceive them as typical behaviors. If you want to pass along healthy habits to your kids, don?t just tell them what to do, show them you?re doing it, too. Kids are likely to follow our lead, so set a healthy example before your unhealthy behaviors become their lifelong bad habits.?

If you do this: Serve yourself large portions of food at mealtime.

Try this: Divide and conquer your plate.

One of the best models to follow at mealtime is our national food icon, MyPlate (www.choosemyplate.gov). The message is simple and effective: fill half the plate with colorful fruit and vegetables; fill the smallest part with a lean protein (like chicken, fish or lean beef) and fill about a quarter of the plate with grains (preferably whole grains like whole wheat bread, oat and bran cereals or whole grain pasta). Eat fewer calories by eating off of a smaller plate.?

Facial recognition tech watches you shop

When you next shop for that perfect pair of jeans, know that retailers may be harnessing facial recognition technology to determine your age, gender and how regularly you shop at their stores. The data collected will help retailers fine tune their marketing pitches and in-store displays.

Such a service is already being rolled in out Japan via NEC. It runs via the company?s cloud computing technology, which means all a retailer needs is a web-connected computer, a video camera and about $880 a month to pay for it, according to video news website Diginfo TV.?

While facial recognition technology is hardly new, the service highlights the transition of the technology from the land of high security and casinos to the shopping mall ? and is one more data point showing that all anyone needs is your picture to know everything about you.?

Senate leader McConnell a big loser on Election Day

WASHINGTON (Reuters) - U.S. Senate Republican Leader Mitch McConnell set two top goals for the 2012 election: a Republican takeover of the Senate and the defeat of President Barack Obama.

He achieved neither.

Starting in January, he will be up against a president he tried and failed to bring down, with a Senate minority weaker by two.

"We all had a bad day," said Josh Holmes, chief of staff of McConnell's personal Senate office.

While there is no sign of any immediate threat to his job as minority leader, McConnell is facing intensified criticism from the right, which has seen him for some time as too "establishment."

McConnell blocked much of Obama's agenda the past two years, including his call to increase taxes on the wealthiest Americans. But some conservatives complained that he was not sufficiently hardline. They were outraged, for example, when he compromised with Obama and agreed to increase the debt limit in 2011 and extend a payroll tax cut.

McConnell is also looking over his shoulder at his own re-election prospects in Kentucky in 2014 and the possibility of a primary challenge from the right, which could limit his flexibility in negotiations over pressing tax and spending issues such as the "fiscal cliff."

To fend off a possible challenge by a candidate backed by the conservative Tea Party movement, McConnell hired Jesse Benton as his campaign manager - a political strategist with Tea Party ties.

"McConnell will be in the middle of a battle for the heart of the party," said James Thurber of American University's Center for Congressional and Presidential Studies. "The Republican Party is shifting to the right under his feet. He may not survive."

Asked whether he would support McConnell for minority leader this week when Congress returns for its post-election session, conservative Wisconsin Senator Ron Johnson said, "I'm going to wait to hear what everyone has to say when we get back on Tuesday."

He added, "I want to see a really well-thought-out strategy about how we are going to be handling the next two years," both legislatively and politically.

Another Tea Party-backed Republican senator, Mike Lee, rose to McConnell's defense. "This is not the time for a circular firing squad," Lee told Reuters in a telephone interview. "We need to come together and move forward."

"Mitch is a strong conservative. Those who criticize his leadership must remember he has a tough job," Lee said.

"The positions he takes as leader, which might be of concern to some conservatives, often reflect where the center of gravity is in our conference - and not reflect where he is," Lee said.

President Barack Obama's decisive victory over Republican challenger Mitt Romney helped Senate Democrats not only keep the chamber, but expand their majority by two, provided that newly elected Maine independent Angus King caucuses with Democrats.

Among the newly elected Republican senators are conservatives Ted Cruz of Texas, Deb Fischer of Nebraska and Jeff Flake of Arizona.

'REALLY BAD CANDIDATES'

Republicans have not controlled the Senate since 2007. They were optimistic about gaining the majority in the 100-member body in part because they had to defend only 10 seats, compared to 23 for the Democrats.

"Look at the numbers," said Paul Sracic, head of the political science department at Youngstown State University in Ohio. "McConnell is a big loser. But it's not all his fault. Republicans had some really bad candidates."

That argument has not stopped some conservatives, such as veteran activist Richard Viguerie, from calling for McConnell's replacement with someone "more in tune with the grassroots of the conservative base of the Party," as Viguerie wrote on his website, conservativehq.com.

But the Republican right wing contributed significantly to Republican Senate race losses by backing candidates such as Richard Murdock in Indiana and Todd Akin in Missouri whose comments on rape and abortion helped Democrats win in two states that might otherwise have gone Republican.

Back in McConnell's Senate office, chief of staff Holmes explained that his boss's role is an important but limited one.

"He (McConnell) is not the presidential nominee's campaign manager," Holmes said. "He isn't a puppeteer controlling the actions of 20 (Senate) campaigns across the country."

"His job is to manage the conference and push for the most conservative solutions possible up here," Holmes said.

Ethan Siegal of the Washington Exchange, a private firm that tracks Washington for institutional investors, said he expects McConnell to prevail next year.

"McConnell is a smart politician with sharp elbows," Siegal said. "He knows how to cut a deal and he's smart enough to worry about a challenge from the right until it happens or not."

Jennifer Duffy, who tracks Senate races for the nonpartisan Cook Political Report, said McConnell's move in hiring a Tea Party sympathizer as campaign manager may convince the Tea Party to leave him alone in the 2014 election.

Duffy said some Democrats may try to take on McConnell in Kentucky, but "it is unclear who it will be. McConnell has already raised a ton of money."

Big Sandy clean-up: Volunteers dive in to help

In Seaside Heights, N.J., residents grab what they can from their homes that were ravaged by Hurricane Sandy. NBC's Michelle Franzen reports.

Hundreds of volunteers got on buses at City Hall on Saturday morning to make their way out to areas still struggling from Sandy's devastation.

Mayor Michael Bloomberg dedicated Saturday a day of service as volunteers spent the day distributing aid and helping with storm recovery efforts.

Teams cleaned up the beach and boardwalk in Coney Island, handed out food and water and helped with the cleanup on Staten Island, and hosted a clothing drive and children's carnival in Rockaway.


In a church parking lot on New Dorp, Staten Island, Walt Street cooked food for storm victims. Street, who had driven 30 hours from New Orleans, Louisiana to pitch in with relief efforts, said the scenes he was seeing on Staten Island reminded him of his hometown after Hurricane Katrina.

Coney Island's New York Aquarium is filled with wonders from the sea, but during Hurricane Sandy the ocean devastated it. NBC's Mara Schiavocampo reports.

Defend New York: Experts on protecting against storms

On Long Island, about 300 people staged a rally in front of the Long Island Power Authority's office in Hicksville Saturday. Approximately 130,000 homes and businesses were still without power on Long Island.

"We are sitting in a cold house. No one comes by,'' said John Mangin of Levittown. "There should be criminal charges against the CEO and the executive board of LIPA for failure to do their jobs.''

Gov. Andrew Cuomo has called for an investigation of the region's utilities, criticizing them as unprepared and badly managed. On Friday, two congressmen from Long Island called for the federal government to help LIPA restore electricity.

"It's a totally disorganized effort, and LIPA unfortunately seems to have lost control of the situation and that's why you see so many people becoming so angry,'' Rep. Peter King said Saturday.

LIPA chief operating officer Michael Hervey said they were aware customers haven't gotten the information they've needed from the utility, partly because of an outdated information technology system they're in the process of updating.

"I certainly feel the frustration of customers whose power remains out. Our hearts go out to them," Hervey said.

But he said workers are repairing unprecedented storm damage as fast as they can. About 6,400 linemen and 3,700 tree trimmers are at work, compared with 200 linemen on a normal day.

In New Jersey, Gov. Chris Christie said he expected power to be restored across the state by Saturday night. As of Saturday evening, Jersey Central Power & Light had nearly 62,000 customers overall without power.? Public Service Electric & Gas said 5,580 customers remain without power from the hurricane. Another 17,148 customers -- including those who lost electricity during the nor'easter and in recent days -- were also awaiting restoration. About 100 Orange & Rockland customers had no power, while Atlantic City Electric had roughly 2,480 outages.

Con Edison said just under 20,000 customers were without power, with just under 9,000 of those outages in Westchester county. Virtually all utility customers in Connecticut have had their power restored.

Cuomo announced Saturday that New Yorkers who lost their job or income because of Sandy would now have until February 4, 2013 to apply for federal disaster unemployment assistance. Claimants also now have up to 90 days to submit proof of employment or self-employment and will be provided an IRS link to speed up the retrieval of lost or destroyed tax documents.

New Jersey moved about 200 people from tents at the Monmouth Park Racetrack into the track's four story grandstand building. The storm victims were initially staying in a? camp designed for out of state utility workers, but the state came under fire after photos emerged showing people huddled together in snow covered tents.

The Statue of Liberty was illuminated for the first time since Sandy, after the storm caused significant damage to statue and to Ellis Island. The dock at Liberty Island that welcomes visitors was so badly damaged it might have to be rebuilt, officials said. The statue's interior had just reopened to the public before the storm hit. No word yet on when the statue will open to the public again.

Cuomo announced the MTA will resume service on the A subway line to Howard Beach Sunday. A shuttle bus will run from Howard Beach to Mott Avenue in Far Rockaway until the heavily damaged north channel bridge can be repaired.

Rockaway will also get temporary weekday ferry service into Manhattan starting Monday. Mayor Bloomberg announced the trips will cost two dollars each way. The ferries will make five morning rush hour trips to Pier 11 in lower Manhattan starting at 5:45 a.m., and five evening trips back to Rockaway. Free transfers from Pier 11 to the East 34th street midtown ferry terminal will be made available.

President Barack Obama will travel to the New York area next week to view the recovery from Sandy and thank first responders, the White House announced Friday.

Obama visited the Jersey Shore last week after Sandy pummeled the tri-state, telling storm victims: "We are here for you and we will not forget. We will follow up to make sure you get all the help you need to rebuild."

At the time, Bloomberg said he told Obama's chief of staff that the city "would love to have him, but we've got lots of things to do."

On Friday the mayor said "we've made significant progress since then and we're happy to have him."

Cuomo also announced the creation of the Empire State Relief Fund, intended to help residents repair and return to homes flooded and damaged when the storm hit last week. He says the best temporary housing is permanent housing and it's cheaper in the long run for taxpayers.

Bloomberg also announced a Sandy repair program, called NYC Rapid Repairs, aimed at getting as many people as possible back into their homes by year's end. Starting Tuesday people with storm-damaged homes can go to a city restoration center, get a Federal Emergency Management Agency number and sign up. Then a contractor will go to the person's home, assess the damage and "within a short time, the work will be done," Bloomberg said.

High court to take new look at voting rights law

WASHINGTON (AP) ? The Supreme Court will consider eliminating the government's most potent weapon against racial discrimination at polling places since the 1960s. The court acted three days after a diverse coalition of voters propelled President Barack Obama to a second term in the White House.

With a look at affirmative action in higher education already on the agenda, the court is putting a spotlight on race by re-examining the ongoing necessity of laws and programs aimed at giving racial minorities access to major areas of American life from which they once were systematically excluded.

"This is a term in which many core pillars of civil rights and pathways to opportunity hang in the balance," said Debo Adegbile, acting president and director-counsel of the NAACP Legal Defense and Educational Fund.

In an order Friday, the justices agreed to hear a constitutional challenge to the part of the landmark Voting Rights Act that requires all or parts of 16 states with a history of discrimination in voting to get federal approval before making any changes in the way they hold elections.

The high court considered the same issue three years ago but sidestepped what Chief Justice John Roberts then called "a difficult constitutional question."

The new appeal from Shelby County, Ala., near Birmingham, says state and local governments covered by the law have made significant progress and no longer should be forced to live under oversight from Washington.

"The America that elected and reelected Barack Obama as its first African-American president is far different than when the Voting Rights Act was first enacted in 1965. Congress unwisely reauthorized a bill that is stuck in a Jim Crow-era time warp. It is unconstitutional," said Edward Blum, director of the not-for-profit Project on Fair Representation, which is funding the challenges to the voting rights law and affirmative action.

But defenders of the law said there is a continuing need for it and pointed to the Justice Department's efforts to block voter ID laws in South Carolina and Texas, as well as a redistricting plan in Texas that a federal court found discriminated against the state's large and growing Hispanic population. "What we know even more clearly now than we did when the court last considered this question is that a troubling strain of obstructing the path to the ballot box remains a part of our society," Adegbile said.

Since the court's decision in 2009, Congress has not addressed potential problems identified by the court. Meanwhile, the law's opponents sensed its vulnerability and filed several new lawsuits.

Addressing those challenges, lower courts have concluded that a history of discrimination and more recent efforts to harm minority voters justify continuing federal oversight.

The justices said they will examine whether the formula under which states are covered is outdated because it relies on 40-year old data. By some measures, states covered by the law are outperforming some that are not.

Tuesday's election results also provide an interesting backdrop for the court's action. Americans re-elected the nation's first African-American president. Exit polls across the country indicated Obama won the votes of more than 70 percent of Hispanics and more than 90 percent of blacks. In Alabama, however, the exit polls showed Obama won only about 15 percent of the state's white voters. In neighboring Mississippi, the numbers were even smaller, at 10 percent, the surveys found.

The case probably will be argued in February or March, with a decision expected by late June.

The advance approval, or preclearance requirement, was adopted in the Voting Rights Act in 1965 to give federal officials a potent tool to defeat persistent efforts to keep blacks from voting.

The provision was a huge success, and Congress periodically has renewed it over the years. The most recent occasion was in 2006, when a Republican-led Congress overwhelmingly approved and President George W. Bush signed a 25-year extension.

The requirement currently applies to the states of Alabama, Alaska, Arizona, Georgia, Louisiana, Mississippi, South Carolina, Texas and Virginia. It also covers certain counties in California, Florida, New York, North Carolina and South Dakota, and some local jurisdictions in Michigan and New Hampshire. Coverage has been triggered by past discrimination not only against blacks, but also against American Indians, Asian-Americans, Alaskan Natives and Hispanics.

Before these locations can change their voting rules, they must get approval either from the U.S. Justice Department's civil rights division or from the federal district court in Washington that the new rules won't discriminate.

Congress compiled a 15,000-page record and documented hundreds of instances of apparent voting discrimination in the states covered by the law dating to 1982, the last time it had been extended.

Six of the affected states, Alabama, Arizona, Georgia, South Carolina, South Dakota and Texas, are backing Shelby County's appeal.

In 2009, Roberts indicated the court was troubled about the ongoing need for a law in the face of dramatically improved conditions, including increased minority voter registration and turnout rates. Roberts attributed part of the change to the law itself. "Past success alone, however, is not adequate justification to retain the preclearance requirements," he said.

Jurisdictions required to obtain preclearance were chosen based on whether they had a test restricting the opportunity to register or vote and whether they had a voter registration or turnout rate below 50 percent.

A divided panel of federal appeals court judges in Washington said that the age of the information being used is less important than whether it helps identify jurisdictions with the worst discrimination problems.

Shelby County, a well-to-do, mostly white bedroom community near Birmingham, adopted Roberts' arguments in its effort to have the voting rights provision declared unconstitutional.

Yet just a few years earlier, a town of nearly 12,000 people in Shelby County defied the voting rights law and prompted the intervention of the Bush Justice Department.

Ernest Montgomery won election as the only black member of the five-person Calera City Council in 2004 in a district that was almost 71 percent black. The city redrew its district lines in 2006 after new subdivisions and retail developments sprang up in the area Montgomery represented, and the change left his district with a population that was only 23 percent black.

Running against a white opponent in the now mostly white district, Montgomery narrowly lost a re-election bid in 2008. The Justice Department invalidated the election result because the city had failed to obtain advance approval of the new districts.

The case is Shelby County v. Holder, 12-96.
